本規約は、株式会社SKIDAY（以下「当社」）が提供するInstagram自動投稿サービス（以下「本サービス」）の 利用条件を定めるものです。本サービスをご利用いただくお客様（以下「利用者」）は、本規約に同意したものとみなします。
本サービスは、当社がスキー場・観光施設等に設置したライブカメラで撮影した画像を、あらかじめ利用者が 指定した設定に従って短時間の動画に編集し、利用者のInstagramプロフェッショナルアカウントへ 自動的に投稿するものです。

本サービスが投稿する画像は、ライブカメラが自動的に撮影した実際の景観です。 当社は撮影内容を人為的に加工・演出することはありません。
ただし、次の場合には投稿が行われないこと、または意図した内容と異なることがあります。
当社は、投稿された画像の視認性・美観について保証するものではありません。
利用者は、本サービスの利用にあたり次の行為を行ってはならないものとします。
利用者は、次のいずれかの方法により、いつでも当社との連携を解除できます。解除後、投稿は直ちに停止します。
解除に伴うデータの削除については、データ削除の手順をご確認ください。
本サービスの利用料金、支払方法および契約期間は、個別契約に定めるところによります。
ライブカメラで撮影された画像の著作権は当社に帰属します。利用者は、本サービスを通じて 自らのアカウントに投稿された画像を、自らの広報活動の範囲で利用できるものとします。
利用者が当社に提供したロゴその他の素材に関する権利は、利用者または正当な権利者に留保されます。
本サービスは、Meta Platforms, Inc.（以下「Meta社」）が提供するInstagram Platform APIを利用しています。 本サービスはMeta社が提供・後援・推奨するものではなく、Meta社は本サービスについて一切の責任を負いません。
当社は、Meta社が定めるプラットフォーム利用規約およびデベロッパーポリシーを遵守します。
本サービスにおける情報の取り扱いは、プライバシーポリシーに定めるところによります。
当社は、本規約を変更することがあります。変更後の規約は、本ページに掲載した時点から効力を生じます。 重要な変更を行う場合は、利用者へ個別に通知します。
本規約は日本法に準拠します。本サービスに関して当社と利用者との間に紛争が生じた場合、 長野地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms govern the use of the Instagram auto-posting service (the "Service") provided by SKIDAY Inc. ("we", "us"). By using the Service, the client ("you") agrees to these Terms.
We capture images from live webcams installed at ski resorts and tourism facilities, compile them into short time-lapse videos according to your configured settings, and publish them automatically to your Instagram professional account as Stories or Reels.
You must have a service contract with us, your Instagram account must be a professional (Business or Creator) account, and you must grant our application the permissions required to create posts. We request only the minimum permissions necessary to publish content. We do not read direct messages, retrieve follower data, or delete or edit your existing posts, and we never hold your password.
You are responsible for ensuring that content published through the Service does not infringe the rights of third parties, for complying with Instagram's Terms of Use and Community Guidelines, and for securing your own account credentials.
Published images are actual scenery captured automatically by live webcams; we do not stage or artificially alter them. Posting may not occur, or may differ from what you expect, in the event of camera failure, communication loss, poor visibility (snow, condensation, fog, backlighting), unmet weather conditions you configured, or Meta-side outages or policy changes. We do not warrant the visibility or aesthetic quality of any individual post.
You may disconnect at any time from Instagram Settings → Security → Apps and Websites, or by contacting us. Posting stops immediately. See our Data Deletion Instructions.
We may temporarily suspend the Service for maintenance, incident response, or to accommodate changes to the Meta platform. We may modify or discontinue the Service, giving one month's notice before discontinuation where practicable.
Except in cases of our wilful misconduct or gross negligence, we are not liable for damages arising from interruption of the Service. Where we are liable, our aggregate liability is limited to the service fees you paid for the month in which the damage occurred. We are not liable for damages arising from Meta's suspension or restriction of our application.
Copyright in webcam images belongs to us; you may use images published to your own account for your own promotional purposes. Rights in logos and other materials you supply remain with you or their rightful owner.
The Service uses the Instagram Platform API provided by Meta Platforms, Inc. The Service is not provided, sponsored, or endorsed by Meta, and Meta bears no responsibility for it. We comply with the Meta Platform Terms and Developer Policies.
Handling of information is governed by our Privacy Policy.
These Terms are governed by the laws of Japan. The Nagano District Court shall have exclusive jurisdiction of first instance over any dispute arising in connection with the Service.
